Lawyers’ practice in mediation is evolving with the widespread use of processes other than litigation which have been commonly referred to as the alternative dispute resolution (‘ADR’) options in Australia. Legal representation in mediation is part of the changing nature of legal work and is informed by the Australian Solicitors’ Conduct Rules (‘ASCR’) and practice guidelines. This article explores selected areas in the Law Council of Australia Guidelines for Lawyers in Mediation (‘LCA Guidelines’) and the ways that these guidelines provide (...) a normative framework for practice including the incorporation of ethical rules. The article argues that the guidelines should be revised to promote legal practice that includes emotion, which may encourage settlement by assisting in identifying core concerns. It draws on a variety of Australian empirical studies on emotion including lawyers’ practice and judges’ engagement with emotion in their role. It recommends revising the LCA Guidelines to better engage with emotions, and additionally, the opportunity for law school dispute resolution curriculum to incorporate engagement with emotion using the LCA Guidelines is raised. This article reflects on how the issue of the Real allows us to rethink the human of today in a more complete and up-to-date way. And for this purpose, two apparently dissimilar perspectives of understanding the Real are discussed: that of the Slovenian philosopher Slavoj Žižek, which is rooted in Lacan’s psychoanalysis, and that of the Spanish philosopher Xavier Zubiri, which is born from a deep critical dialogue with Heidegger’s ontology. This paper will show the unity of two visions of (...) the Real that lie at the heart of what is human and that allow us to criticize certain very influential psychoanalytic thought, centred on Jacques-Alain Miller, which cannot account for what is happening to us radically in the current era, or, perhaps, in any era. By applying Mills’ notion of ‘collective memory’, Frost-Arnold argues that an excessive number of false beliefs online (fake news) can condition the memory that we share as a collective. Here I suggest, following Mill’s original characterization of ‘ignorance’, that the construction and maintenance of our collective memory is also vulnerable to some lack of or total absence of true beliefs online. I suggest we must investigate these beliefs attending to two issues: firstly, instances of knowledge that are underrepresented, and secondly, (...) non-propositional forms of knowledge. The first problem is addressed in section 1, where I explore different ways in which some beliefs might not reach the online sphere, due to their minoritarian status. The second problem is my focus on section 2, which entails the consideration of non-dominant forms of knowledge: knowledge-how and knowledge by acquaintance. Aplicando la noción de 'memoria colectiva' de Mills, Frost-Arnold argumenta que un exceso de creencias falsas en línea (fake news) puede condicionar la memoria que compartimos como colectivo. Aquí sugiero, siguiendo la caracterización original de ‘ignorancia’ de Mill, que la construcción y mantenimiento de nuestra memoria colectiva también es vulnerable a cierta falta o ausencia total de creencias verdaderas en línea. Propongo que debemos investigar estas creencias atendiendo a dos cuestiones: en primer lugar, a instancias de conocimiento que están subrepresentadas y, en segundo lugar, a formas no proposicionales de conocimiento. The standardization of the display of intimacy implies that transparency is normalized in the information society. Social practices are bringing the idea of emancipation to the technological field. This carries significant but unquestioned socio-political expectations that are associated with powerful cybercompanies. Byung-Chul Han treats these issues in his political texts. He argues that transparency is a neoliberal device which does not help solve the problems of citizenship, and it even involves a “depoliticization”. My intention is to carry out a critical (...) review of his texts, and highlight their convergences with other authors dedicated to the philosophy of technology. (shrink)

The dropout rate among Spanish university students is very high compared to the European mean, creating a pressing need for the introduction of policies and programmes aimed at increasing rates of persistence. In this article, we study this problem by combining students? perceived learning outcomes with their dropout intentions, and we propose a research model that considers subjective factors that might impact this decision. The model is estimated for two degree courses: Business Administration and Nursing. The estimation method uses structural (...) equations based on the partial least squares algorithm. This allows the construction of indices for the variables of interest, enabling us to make comparisons between courses and over time. To reduce dropout intentions, efforts need to be focused on obtaining better cognitive outcomes, as well as on achieving a higher level of student satisfaction with their university experience. Based on evidence that learning new characters through handwriting leads to better recognition than learning through typing, some authors proposed that the graphic motor plans acquired through handwriting contribute to recognition. More recently two alternative explanations have been put forward. First, the advantage of handwriting could be due to the perceptual variability that it provides during learning. Second, a recent study suggests that detailed visual analysis might be the source of the advantage of handwriting over typing. Indeed, in that study, (...) handwriting and composition –a method requiring a detailed visual analysis but no specific graphomotor activity– led to equivalent recognition accuracy, both higher than typing. The aim of the present study was to assess whether the contribution of detailed visual analysis is observed in preschool children and to test the variability hypothesis. To that purpose, three groups of preschool children learned new symbols either by handwriting, typing, or composition. After learning, children performed first a four-alternative recognition task and then a categorization task. The same pattern of results as the one observed in adults emerged in the four-alternative recognition task, confirming the importance of the detailed visual analysis in letter-like shape learning. In addition, results failed to reveal any difference across learning methods in the categorization task. The latter results provide no evidence for the variability hypothesis which would predict better categorization after handwriting than after typing or composition. (shrink)

Despite social epistemologists’ condemnation of epistemic bubbles (Nguyen, 2018; Miller & Record, 2013; Pariser 2011; Simpson, 2012; Sunstein 2017), we defend that they may be epistemically beneficial for marginalized communities, especially when they help insiders to make sense of their lived experiences, that is, acquiring hermeneutical resources. Building on the previous work of Anderson (2021), Sunstein (2017) and Frost-Arnold (2021), who have already highlighted the epistemic benefits of certain bubbles, we focus on the case of Cystic Fibrosis (CF), a chronic (...) illness with severe symptoms, whose patients face difficulties to understand their own experience (for example, what being ‘young’ means with a reduced life expectancy). We then explain how they engage in what we assess as, following Medina & Whitt (2021), “epistemic activism” in a Facebook group meant for patients to share and interact with their favourite CF-related memes. The case illustrates how conditions of isolation and technological affordances contribute to a hermeneutical gain in the marginalized community (augmenting the community’s agency, amplificating their voices, and allowing them to develop and exercise their epistemic capacities). Lastly, we present the ethical guidelines (inspired in Frost-Arnold 2023) we have followed to engage in this sort of online research. (shrink)

Este artículo se sumerge en la gran categoría de real (sustantividad) de Zubiri para hacerla dialogar con Butler y en ello generar una fundamentación actual para la teoría crítica, el feminismo, el psicoanálisis que nos permita entender al humano y en estos tiempos de la mejor forma posible. Para ello se muestran ciertos aspectos muy importantes que generan nexos entre ambos pensadores (como Hegel) y también nos permite entender a Zubiri como un pensador radicalmente de lo social. Y su filosofía (...) nos daría una fundamentación para dar cuenta de lo que hoy se llama teoría queer y de los movimientos LGTBQIA+. (shrink)

En este articulo me centro en las referencias de Maimónides al alma, fundamentalmente en los escritos médicos. El alma es un tema frecuente en las obras de medicina tanto por sus facultades, que definen funciones esenciales para la vida humana, como por las afecciones anímicas, pero se puede decir que Maimónides no trata el asunto de una manera convencional. Además de reflejar en estos escritos el hecho de que no es sólo médico sino también filósofo y un hombre de religión, (...) lo más peculiar son sus convicciones personales acerca de la prevención, y cura de las enfermedades mentales. RESUMO O intuito deste artigo é estudar o objetivo principal da estética musical de Boulez, para o início das comemorações de seus 90 anos, desde certas categorias de Deleuze, considerando que elas nos permitem compreender e delinear uma lógica da sensação sonora. Se Deleuze se ocupou em detalhe do trabalho de Francis Bacon, por exemplo, a fim de criar uma "lógica da sensação visual" em que o conceito de "Figura" fosse central, propomos que o trabalho musical de Boulez, analisado a (...) partir do pensamento de Deleuze, possa mostrar os momentos decisivos de uma "lógica da sensação sonora." Por meio de alguns trabalhos de Boulez podemos ver dois elementos muito importantes para nossa pesquisa dados na estrutura instalada pela filosofia de Deleuze. Esses dois elementos que darão forma a este artigo são: as "figuras" da música e as "forças" do som expressivo. ABSTRACT This article aims to study the main objective of musical aesthetics of Boulez, to begin to commemorate 90 years, since certain categories of Deleuze, as they allow us to understand and outline a logic of sound sensation. If Deleuze worked in detail the work of Francis Bacon, for example, to create a "logic of visual sensation" where the concept of "Figure" is central, we propose that the musical work of Boulez, analyzed from Deleuze's thought, be possible to show the decisive moments of a "logic of sound sensation." Along some works by Boulez we can see two very important elements for our research in the framework installed Deleuze's philosophy are given. For this, a detailed investigation of the most important milestones is carried out where social reality is worked in accordance with the work of the philosopher. Se muestra cómo la “inteligencia sentiente”, en sus elementos “noológicos”, adquiere cierto carácter “técnico” primario y constitutivo que se despliega en el logos y en la razón de manera individual, social e histórica. En la aprehensión primordial de la realidad se juega la viabilidad misma del hombre en su estar siendo en el mundo como animal humano, donde lo “técnico” juega un papel relevante. En los elementos noológicos primarios de la aprehensión primordial se hallan los cimientos de los que surge (...) la “técnica”, que no es entonces elemento accesorio, sino parte constitutiva del hacerse cargo de la realidad. Se indaga el problema de la explotación técnica del mundo a partir de los pensamientos de Xavier Zubiri y Georges Canguilhem. Se examina el análisis zubiriano de la inteligencia humana y la tesis de Canguilhem sobre la originalidad de la actividad técnica, su relación con la ciencia y su papel en la normatividad del organismo. En ambos autores, el término Umwelt, traducido como “circun-mundo” o medio de comportamiento propio, sirve como base para establecer las posibilidades que tiene la técnica en (...) el desarrollo de nuevas formas de relación con el medio ambiente. Este artículo muestra varios detalles para entender la compleja figura de Ariadna en el pensamiento de Nietzsche, pero que va más allá del autor alemán y se sumerge en ciertos momentos de Ariadna, desde lo etimológico a Otto pasando por Ovidio y Catulo, para dar cuenta de una Ariadna que es la compañera del dios Diónysos y que en cierta forma posibilita la propia verdad del dios; lo que Nietzsche llamaría “eterno retorno”.

La aparición y difusión pandémica del virus SARS-CoV-2 ha evidenciado que el sistema tecnocientífico de investigación, desarrollo, innovación y difusión presenta problemas de previsibilidad, de gestión de riesgos y un alto nivel de incertidumbre. Este trabajo analiza el proceso de producción, gestión y difusión del conocimiento centrándose en los modos y medios tecnocientíficos y sociales de información y comunicación científica sobre la COVID-19. Para ello, en primer lugar, se ha realizado un análisis de los déficits del modelo tecnocientífico de producción (...) y gestión del conocimiento durante la crisis de la COVID-19. En segundo lugar, se ha estudiado el tratamiento y difusión de información en los nuevos modos de información y comunicación social donde se ha generado una circunstancia de infoxicación. En tercer lugar, para evaluar si está teniendo lugar una efectiva comunicación y discusión entre las comunidades científicas, se ha realizado un estudio bibliométrico a partir de los datos de la Web of Science sobre la publicación de resultados de investigación desde 2020 en relación con el virus, su enfermedad y tratamiento. El objetivo de este artículo es estudiar el Curso de Xavier Zubiri de 1975 Reflexiones sobre lo estético a la luz de la “noología”, horizonte de pensamiento que el autor español dejó planteado al final de su vida. Allí lo estético cobra otra dimensión en su estudio al vincular las tres esferas de la noología: la aprehensión primordial de la realidad, el logos sentiente y la razón sentiente. A partir de estas tres categorías cardinales, vemos lo estético en un primer (...) nivel de la aprehensión misma, otro segundo nivel en donde lo estético se diseña y son las artes las que expresan lo fruitivo de la realidad y por último, un tercer nivel que son las obras de arte propiamente dichas. Lo que se pretende con este artículo es pensar el Ereignis de Heidegger a la luz del problema del Sein en un triple referente; el cual se muestra en tres palabras fundamentales: Wink, Aufriss y Destruktion. Esto nos llevará a estudiar someramente a nuestro autor desde los cursos de los años veinte anteriores a Sein und Zeit hasta el Seminario de Le Thor de 1969. Pero todo este horizonte de pensamiento estará articulado desde los Beiträge zur Philosophie. Vom Ereignis (1936-38).

This paper inquires in a central question in the Jean-Luc Nancy’s work, that is, the end of the West and his inmediate concequence: the return schema. The evaluation that Nancy realize is associated to his affirmation about this question is that the West has finished product planetary extension of its foundational philosophical slogans. The main argument is that one of the most conspicuous causes of that finishing is the global structure, regulated by the exclusive pattern of the One, in any (...) case, neutralizer considered singular beings. It is argued that the main output to said planetary nancyana neutralization is the concept of a community of singular beings under the being-in-common that cover deploys unique and unrepeatable sense networks.
